GAME POLICY

Cthulhu Nation (developed and operated by Twisted Empire) provides family-friendly entertainment to our users. We are committed to protecting the safety and security of its online visitors and are sensitive to our user's concerns about the safety of the personal information provided to us. We encourage all our users to read this Privacy Statement carefully in order to understand how any personal information collected about you is used.

We are also aware that due to our content we may have some younger users on our site. Whilst this game (Cthulhu Nation)does not carry any recognised age certification as to its content, we give our own recommendation that older, more responsible children (13+), play this game due to the more mature audience that the game attracts. This reflects not only on the game content itself, but also on the chat rooms and the forum content.

We recognize the need to provide additional protection to those younger users. The Children's Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age; and that we obtain the consent of parents and guardians in order for the children under 13 years of age to use our website. We explain this information under the Childs' Privacy Policy section below.


Information You Provide to Us And How We Use This Information

I. Free Accounts


Cthulhu Nation has a portion of the game available to all users for free. In order to register a character for the free version of the game, the only information that Cthulhu Nation collects is the user's e-mail address. The e-mail address is used for the following purposes:

* To send a confirmation notice to the user of their character registration and password information.
* Upon the user's request, to send the user password information when the user has lost or forgotten the password.
* In response to any question, concerns or problem that the user contacted Cthulhu Nation about.
* To contact the user about any problem with the user's account or conduct in the game.
* To send out a newsletter (#).

(#) The Cthulhu Nation game is unique in the sense that we design and run numerous special events that keep the game constantly fresh, challenging, fun and interesting for our users. Some of these events coincide with actual timeline dates, other events are made up as we go along. We use the newsletter to notify our users of all the current events, changes, improvements, upgrades, new characters, etc.


Free Play Policy:

Free play to Cthulhu Nation is accessible to any player at any time. However, the content of the game is limited and many features and functions of the game are not available during free play. There are no time limits to the amount of time a registered (but non-subscribed) player can participate in the game, but there will be limited map access, item availability, character development and quest accessibility.


However, many new subscribers join Cthulhu Nation and, for one reason or another, decide not to participate any more. Their registration details are held on our database, along with all their character attributes gained during the course of their gameplay. Consequently, we occasionally find large numbers of players who have not actively participated in the game for a long time. This slows our system down, and periodically we remove accounts that have been inactive for a period of 3 Months or longer. All players should be aware of this so that they can make an informed decision as to their continued participation within the game before their account is deleted.


A 'Token' system operates within the game, in which all players (free play and subscriber) can purchase in-game tokens to buy various virtual goods and abilities. These are purchased with real cash by players, but can be converted within the game in a number of ways. They can also be disposed of within the game in a number of ways, for example by auctioning them off in the game's Auction House, or exchanged with another character (player) for appropriate goods or services within the game. If you lose your subscription status, you become a 'free-play' character. Whilst some of the game elements allow for the use of tokens under these circumstances, the onus is placed firmly on the player to dispose of any paid-for tokens within the mechanics of the game during this period. We cannot reasonably be expected to reimburse these costs at a later date, as we assume the player has a responsibility to decide their own actions regarding their token purchase and continued gameplay decisions.


II. Subscriber Accounts

A Subscriber Account is a paid membership account that provides our users with additional access and privileges whilst playing Cthulhu Nation. The Subscriber Account requires and uses all of the information listed under the Free Account in the same manner. In addition to the above, however, we will require you to provide the following information:

* First and last name
* Address, city, state and zip/post code

We are copied with this information by PayPal (see Security and Credit Card Use below) and require this information for the sole purpose of verifying your account and payment information.


Subscriber Policy:

When you subscribe to Cthulhu Nation, you pay for additional features and benefits in the game such as access to other game areas, character abilities and items. If your character is unsubscribed
for whatever reason, whether this be through personal choice not to play the game any more, or your subscription payment is missed, your character will revert back to the 'free-play' status, and all your subscription bonuses will be removed. It should be noted here that due to the automation of our game system, the onus is placed firmly on the subscribing player to ensure that their account is set up and maintained appropriately as we have no control over these issues.


Furthermore, it is our policy that any financial activities undertaken during subscription gameplay that develop, enhance or prosper your character during this period cannot be reimbursed by us if a player unsubscribes. Cthulhu Nation offers and employs 'virtual goods' which remain the property of the company, and any such purchases or developments are for the benefit and enjoyment of the player during their subscription.

Similarly, we offer 'Custom Avatars' to our players. These are purchasable images for personal identification purposes within the game. They are to be considered purchased in good faith by the player at the time for the purpose of personal and general enjoyment during gameplay. We cannot reasonably be expected to reimburse any costs regarding the purchase of such custom avatars once an account has been closed.


Any player found to be in breach of our general or specific policies regarding behaviour or activity within the game that requires us to act on their account/s and remove them from the game will forfeit all rights to reimbursement of any costs or fees they may have paid during their gameplay. This includes, but is not limited to, subscription costs, token purchases, custom avatars, or any other financial investment in Cthuhlu Nation.


All subscription offers are made in good faith on our part. We will endeavour at all times to rectify any legal or technical issues regarding accounts and payments that affect our stated offers. However, all players should be aware that all the goods we offer are 'virtual property', and as such are intended for the personal experience and entertainment of their active involvement during their gameplay.


What We Will NOT DO With Your Personal Information:

Cthulhu Nation is 100% supported by its Subscriber Account Users. Therefore Cthulhu Nation does not sell or knowingly divulge your information to advertisers or any other third parties, unless we are required to share your information with a third party in order to comply with law, to comply with a court order or subpoena; to enforce our site or game rules; to protect the safety and security of our users and our Web sites.


What Are Cookies?

A cookie is a little piece of information handed to a web browser to a web server that contains information that can be retrieved from the server later. Cthulhu Nation uses cookies only to the limited extent of recognizing the registered user and pairing that user with the character that the user created and the account preferences set by that user within the game.


Javascript Use?

Cthulhu Nation uses javascript with a non malicious intent within the game interface. Therefore players need to enable this function in their preferred browser. These scripts are in no way harmful, nor will they create multiple pop-ups or introduce advertising. Most up to date browsers have the facility to allow javascript for specific sites.


Message Boards:

The Cthulhu Nation message board (forum) is a place for users of the game to interact by posting messages. When registering a new accout the player will be automatically signed up with the message board. The message board is subject to TERMS OF USE.


Security and Credit Card Use:

Cthulhu Nation does not process your payments directly. Instead we contract this service to other, secure companies. Please refer to the appropriate section of this Game Policy for further information.


PayPal:

Founded in 1998, PayPal, an eBay Company, enables any individual or business with an email address to securely, easily and quickly send and receive payments online. Children's Privacy Policy:

Cthulhu Nation encourages parents and legal guardians to spend time online with their children. We urge parents and legal guardians to instruct their children to never give out their personal information online without permission. We also recognize a special need to protect personal information obtained from children. In compliance with Children's Online Privacy Protection Act (“COPPA”), we have adopted the following policies regarding children under the age of 13 (“kids”):


Type and Use of Information Collected from Children:

Cthulhu Nation does require all users to provide us with his/her e-mail address in order to set up a free account and register a character in our game. If we are aware that the user is under the age of 13, at this time we require for the parents to set up the account for their Children. The setting up of the account by the parent/s is considering an actual verifiable consent by the parent for the Child to use this website as required by COPPA.


We use your child's e-mail address for the following purposes:

* To send a confirmation notice to the Child of their character registration and password information.
* Upon the Child's request, to send the user password information when the Child has lost or forgotten the password.
* In response to any questions, concerns or problems that the Child contacted Cthulhu Nation about.*
* To contact the Child about any problem with the Child's account or conduct in the game.

* We recognize that young children may inadvertently give out personal information in addition to their e-mail address when contacting us with any questions, problems, or concerns they have encountered while playing the game. We do not collect or use any such additional personal information acquired in this manner unless it is necessary for us to respond to the problem or question or concern. We do not divulge any such information to any third parties unless we are required to do so by law, court order or subpoena.

If a Child desires to upgrade his/her account to Subscriber Status, a parent or legal guardian will be required to divulge additional reasonably necessary information as described above under 'Subscriber Accounts'.

Cthulhu Nation does not sell or knowingly divulge your Child's information to advertisers or any other third parties, unless we are required to share your Child's information with a third party in order to comply with law, to comply with a court order or subpoena; to enforce our site or game rules; to protect the safety and security of our users and our Web sites.

Also, please note that Cthulhu Nation does not condition a Child's participation in an online activity on the Child providing more personal information than is reasonably necessary for the activity.


Notification and Verifiable Parental Consent:

At this time, whenever Cthulhu Nation is aware that a user is under the age of 13, Cthulhu Nation requires for the parents to set up the account for their Children. The setting up of the account by the parent is considered an actual verifiable consent by the parent to the Child's use of our website as required by COPPA.

For Subscriber Accounts, the receipt of payment is considered actual, verifiable consent from the parents to the child's use of our website and to any information that was divulged as reasonably necessary to process payments, verify and maintain the account.


How can parents access, change or delete personally identifiable information about their Children?

Once again, we would like to assure you that we do not keep any information other than what is listed above. However, parents are welcome to contact us about any personally identifiable information about their child by emailing admin@cthulhunation.co.uk. Parents can then request to purge either all or specific portions of that information at that address.


Inappropriate Behaviour:

Cthulhu Nation reserves the right to ban or remove player accounts from the game who use offensive language or are deemed to be acting in a manner which does not respect the rest of our gaming community.


Revision Information:

Cthulhu Nation reserves the right to change, modify, or revise this Privacy Policy in order to comply with any applicable laws or changes within the game or for any other reason at any time. Therefore our users are encouraged to check the Game Policy periodically to read about any changes, modifications, or revisions.
